I got a response from Jelsoft about a Cease and Desist order I sent them recently. Basically, if you don’t know the situation, people on vB.org are constantly abusing the feedback feature and posting libellous content about me and my business on vB.org. So, out of desperation, I wrote a Cease & Desist order to Jelsoft about the matter (hasn’t appeared on Chillingeffects.org yet) and Ashley Bubsy took the ticket. Anyway, I got a reply today stating ”
Bearing in mind that we do keep a close eye on these sorts of things and providing that they are in the rules, they are allowed. This enables others to provide their side of the story, without namecalling or posting personal data so that users can share their experiences. These threads are monitored and cleaned up if appropriate and the threads that you have highlighted are within these guidelines. As you have mentioned that we have received your final communication, please consider that matter concluded.”. (more…)

My image and name are copyrighted/trademarked for certain security reasons and personally. This is mainly to protect me if I try to apply for a job and a person Googles my name. I allow free usage of it under the following licence:
- It is used alongside content that is not libellous, harmful, obscene, harassing, threatening or infringes on the property rights of others.
- It is used with attribution to thedarkestevil.com
- All other purposes must be preapproved by Kyle Korleski.
The reasoning behind this? Well, the reason is that I am new in Canada and I cannot have people soiling my record when my employer Googles my name. Now, Nicholi is a very gracious person but I can’t take any chances if people are going to abuse my image like this. Besides, what of Citizenship and Immigration Canada? What if a CIC visa officer abroad or in Canada came across libellous content that I did not write and assumed that I was somehow associated with it? That would probably raise a few questions to the visa officer and I would probably be asked to attend an interview at a consulate abroad.
Therefore, I decided to file for a trademark at the Canadian Intellectual Property Office and I hold a copyright to my own name. I would highly recommend that any expatriate that is being harassed like I am to do the same. I am not liable for content that I do not write myself.

If you read my post yesterday, you would know that I had a copy of Windows to return to London Drugs today. Well, guess what? They would not allow me to return it. Fuckers. It appears as if I have to beg Nicholi for a small pay advance (actually it would be a loan, seeing as I am getting the money soon, just not before it’s due) on my rent while I scramble to collect the rest of it. However, I know one thing is for certain, London Drugs has lost my business indefinitely.
I like to online shop. That’s because I hate waiting forever for a bus to come and take me to the LRT station so I can head on down to Chinook to purchase a DVD. I would much rather purchase one online but there is one factor that prohibits that. When I want something, I usually want it now and not in a few days. This is unfortunate because I am certain that Amazon.ca has a bit more credibility than London Drugs. And it is unfortunate that they have decided to violate their own guarantee, the guarantee on the packaging AND federal law.
However, I take solace in the fact that not all business are as bad with customer service as London Drugs or Subway are. MediaTemple, my current web host, gave me $40 in credits to my account for the outages in November. I am happy that at least THEY know how to act honourably.

Basically, I am in a whirlwind of relational bullshit and I guess I should try to cut the cords here and now. I am done with online dating and trying to find someone altogether. I hate all the immature people that think that they are all that and everyone should bend down and kiss their ass. I am sick and tired of the abusers and the mercenaries. I guess looking for love online is like looking for a diamond in your ass. It’s dark, hard to navigate and something just doesn’t smell right.
And, it’s not like I am in that stable of a situation either. I am still waiting for Nicholi to submit those papers to Alberta Registries so I can send in my application for a work permit. I thank god that I found Nicholi when I did, because she gave me the ticket I need to immigrate to this country. I now need to get everything rolling so I can immigrate to this country. And it looks like my life is becoming a bit more stable.
I am going to get rid of my current IM identities and get new ones. And I should probably get rid of my MySpace too. I am also tired of trying to reconnect with my past. My past sucked. I know this and yet I want to try to talk to people from my high school. Why am I stressing myself over people who won’t respond to private messages or whatever the hell they call them over at MySpace.

Why is this bad? Well, the Internet is a very social network and it was built to be decentralised and an open standard. However, this bill will make it more impossible to run a website with the truth. How so, you ask? Well, here are the reasons MY blog and site would be effected if Net Neutrality were to fail in the states.
- I tell about my bad experiences of Charter Cable, AOL, Microsoft and all those mother fuckers so once Net Neutrality fails, they will have the power to block my content or make it slower.
- Advertisements and advertising partners will make less payouts to webmasters and give the ISPs and Telcos more money to prioritise their advertisements. Content is king and it is the reason why the Internet is so successful. Would someone watch 30 minutes of television to see 29 minutes of advertisements as opposed to just 6 minutes of advertisements? Of course not! We would get out a bit more and enjoy life and do other things. And eventually, since we wouldn’t be able to see the benefit of having a “high-speed” internet connection, we’d cancel it in a heartbeat.
- Do you really think we’d be able to use Instant Messengers from other ISPs? Like if I were using Yahoo!’s DSL programme in the states, do you think that I would be able to gain the same level of connectivity with MSN Messenger, ICQ and AOL IM that I would gain with Yahoo!? Of course not, because Yahoo! would love to try to drive people to help improve it’s market share.
- Great sites like The Pirate Bay and Boxtorrents would drastically be reduced in popularity as we would probably have an even lower level connection to bittorrent.
- Firefox is gaining considerable steam and market power. Now, if Net Neutrality fails, it may be that the only browser you will be able to use (if you use MSN or an ISP that works with MSN) is Internet Explorer. That sucks, doesn’t it?
So I approve of Net Neutrality.

Here’s an innovative business plan for you: start up an insurance company whose sole purpose is to cover your customers’ fines should they get busted for illegal file sharing, thereby creating a clientele that by default is composed completely of criminals. Well believe it or not, a Swedish “entrepreneur” has begun to offer this very service to his fellow citizens — for only $19 per year, Magnus Braath’s company Tankafritt promises to pay any penalties incurred from crackdowns on your rampant piracy, and he’ll even throw in a free T-shirt to help you glorify your outlaw status. (Yes, you guessed it, the shirt actually does read “I got convicted for file-sharing and all I got was this lousy T-shirt”). Braath claims that he started the business as a statement against recent changes in Swedish law that had the nerve to criminalize illegal downloading, and that low conviction rates and relatively minor fines will allow him to keep the venture financially solvent. Hey Magnus, if you’re looking to expand your operation, we hear that Spain’s just passed some legislation that will probably create quite the demand for your unique little service — who knows, with some hard work and a bit of luck, you could end up becoming the Geico of software and content piracy.
Looks like my file sharing activities might require this later on.
